    Tom, just today Justice Scalia spoke for the Federalist Society, Long Island Lawyer’s chapter at a breakfast event.  I was lucky enough to have him take a question from me during Q&A.  I asked about what he thought about the nullification doctrine as according to Jefferson and Madison in the Kentucky and Virginia Resolutions.  The crowd laughed at the question, presumably because it sounded so obscure.  

    His response was pretty simple: “Didn’t the civil war settle that?”  He went on about how the civil war resulted in more centralization of power and less power in the hands of the individual states, and nullification was for a different era that now settled and long gone.And that is coming from our most originalist Justice on the court.

     I disagree that Scalia is the most originalist justice. I think Thomas is.  I love how so many people can seriously believe that a war can decide which side is “right” in a philosophical/legal argument.  Not to mention the Civil War was not about nullification.
